dc.description.abstractO salário-maternidade consiste no benefício previdenciário de natureza familiar que visa proteger a mãe e seu filho por ocasião do parto, da adoção ou da guarda judicial para fins de adoção. A segurada faz jus ao benefício quando preenche os requisitos previstos em lei, entre eles a idade mínima de 16 (dezesseis) anos, visto que a Constituição Federal de 1988, em seu artigo 7º, inciso XXXIII, proíbe o trabalho a jovens de idade inferior, salvo na condição de aprendiz, a partir dos 14 (quatorze) anos. Ocorre que, entre as indígenas da etnia kaingang, as quais se enquadram quase sempre na modalidade de segurada especial, o trabalho e a gestação, por questões culturais, acontecem antes da idade legalmente estipulada, o que resulta na negação do benefício quando requerido perante o INSS. De outro lado, há uma gama de normas protetivas conferida aos indígenas, que deve ser observada quando da concessão de benefícios previdenciários. O trabalho objetiva analisar a necessidade de um tratamento diferenciado a ser dado às indígenas kaingang na percepção do salário-maternidade, no sentido de afastar a exigência legal da idade mínima, por força dos seus costumes, crenças e tradições, o que se coaduna com o princípio da igualdade material explícito na Lei Maior e nas demais normas estudadas e se alinha à tendência jurisprudencial mais recente.pt_BR
dc.description.abstractThe maternity benefit consists in the pension benefit of family nature that seeks to protect the mother and the child at birth, adoption or legal custody for purposes of adoption. The insured is entitled to the benefit if it satisfies the requirements provided by law, including the minimum age of 16 (sixteen) years, since the 1988 Federal Constitution, in its article 7, paragraph XXXIII, prohibits the employment of young people under the age, except as apprentices, from 14 (fourteen) years old. The problem is that, between the indigenes from the ethnic group kaingang, which fall almost always in the category of special insured, work and pregnancy, for cultural reasons, happen before the legally stipulated age, resulting in the denial of the benefit when it is asked to the Social Insurance Institute. On the other hand, there is a range of protective standards afforded to the indigenous peoples, which should be observed during the grant of pension benefits. The research aims to analyze the need for a differentiated treatment to be given to the indigenes from the ethnic group kaingang when they receive the maternity benefit, in order to ward off the legal minimum age requirement, in the face of its customs, beliefs and traditions, which is consistent with the principle of material equality explicit in the 1988 Federal Constitution and in other rules studied and aligns to the latest jurisprudential trend.en
