A função social da patente farmacêutica

Abstract

A saúde, a qual abarca o direito de assistência farmacêutica, tem uma representação fundamental na vida e, consequentemente, no direito à vida digna das pessoas. Tendo em vista a essencialidade de tal direito, o presente trabalho propõe-se a abordar a busca pela efetiva aplicação e concretização da Função Social das Patentes de Medicamentos, visto que o direito à saúde e o direito a uma vida digna são assegurados pela atual Constituição Federal Brasileira de 1988. Evidentemente, para que a Função Social da Patente Farmacêutica seja cumprida surge a necessidade de imposição de uma série de limitações ao direito patentário, especificamente na área da indústria farmacêutica. Com base nessas idéias apresentadas, o presente trabalho procurará, primeiramente, mostrar o que é a Propriedade Industrial, com ênfase na Patente de Medicamentos, como e por que surgiu e em que consiste o regime jurídico que a regula, tanto no âmbito nacional quanto internacional. Em seguida, refletir-se-á sobre o direito à saúde, assegurado atualmente pela Constituição Federal de 1988, demonstrando em que medida as Patentes Farmacêuticas exercem fortes impactos nesse Direito Fundamental. Procurar-se-á, ainda, identificar os mecanismos jurídico-legais já existentes para assegurar o acesso da população a medicamentos, e também, aqueles passiveis de implementação na atualidade. Dessa forma, buscar-se-á refletir sobre a efetividade e real aplicação dessa Legislação em prol do cumprimento da Função Social inerente à Propriedade Industrial, e, mais especificamente, se o Direito de Patentes de Medicamentos vem exercendo e se tem condições para tanto na realidade corrente.

Health, which includes the right to pharmaceutical services, plays a fundamental role in people’s life and, consequently, in the right to a dignified life. Given the importance of referred right, this paper proposes to address the search for effective application and implementation of the Social Function of Pharmaceutical Patent in order to fulfill the right to health and the right to a dignified life, both ensured by the current Brazilian Federal Constitution of 1988. Evidently, in order for the Social Function of Pharmaceutical Patent to be fulfilled there is the need to impose a number of limitations to patent law, specifically in the area of the pharmaceutical industry. Based on these presented ideas, this paper will seek primarily to show what the Industrial Property is, with an emphasis on Pharmaceutical Patents, how and why it came about and what constitutes the legal framework that regulates it both nationally and internationally. Then it will reflect about the right to health, currently ensured by the Federal Constitution of 1988, demonstrating the extent to which Pharmaceutical Patents have strong impacts on this Fundamental Right. This research will also identify the existing legal mechanisms to ensure people's access to medicines and also those liable to be implemented in the near future. Therefore, it will seek to reflect on the effectiveness and actual application of that legislation in favor of the fulfillment of the Social Function of the Industrial Property, and, more specifically, whether the Pharmaceutical Patents have served their Social Function and if they currently have conditions to do so.
