dc.description.abstractO presente trabalho de conclusão de curso tem por objetivo responder a seguinte pergunta: existe compatibilidade entre os programas de reality show e a função social da TV? Função social da televisão aqui entendida como deveres que devem ser cumpridos e que, especificamente, para este trabalho são os deveres estabelecidos no artigo 221 da Constituição Federal de 1988. Partindo-se da ideia de que a programação televisiva é transmitida com base no serviço de radiodifusão, é destacado que este serviço se reveste de natureza pública. Considerando-se que a quase totalidade dos domicílios tem acesso a programação através do aparelho de televisão, dentro desse contexto de programação, os reality show são programas de grande sucesso de audiência, ao mesmo tempo em que alimentam polêmicas sobre a necessidade de controle da exibição. Ainda partindo da premissa de que a liberdade de programação é a regra estabelecida pelo ordenamento jurídico, o artigo 221 da CRFB tem como núcleo central a liberdade de comunicação. Assim, a ideia em que se assenta o presente trabalho é de que essa liberdade não é ilimitada, possui limites que são impostos pela Constituição, razão pela qual a programação televisiva deve ser controlada e não censurada. Os programas de reality show são, assim, expressão dessa liberdade de comunicação. Assim, a única possibilidade de a difusão de tais programas serem compatíveis com a função social da televisão somente pode acontecer se houver um controle da programação efetivo e eficiente.pt_BR
dc.description.abstractThis term paper aims to answer the following question: is there a compatibility between reality shows and the social function of Television? Social function hereinafter understood as the legal obligations that must be observed - in this paper, specifically – accordingly to the article 221 of The Brazilian Constitution. Considering that television programming is telecast based on service broadcasting it is clear that this service has a public nature. Taking into account that nearly every domicile have access to television programming, and also that reality shows are succesful once noted its rating, they aggrandize the controversy regarding to the need of telecasting censorship. Based on the premise that freedom of production and programming is the rule, established by law, the article 221 of the Brazilian Constitution arises as the core of the freedom of speech. Therefore, the theory on which this paper is based is that the freedom of speech is not unlimited, on the contrary, it has its own limits that are imposed by the Constitution, which is why television programming should be controlled, but not censored. Reality shows are, thus, an expression of freedom of speech. Consequently, the only possibility of telecasting these programs accordingly to the social function of television depends on whether there is an effective and efficient programming control.en
