Caleidoscópio : desvelando o adolescente em conflito com a lei

Abstract

Esta tese investiga a subjetividade dos adolescentes em conflito com a lei e as medidas socioeducativas em meio aberto, quando cometem um ato infracional. O Estatuto da Criança e do Adolescente preconiza a Liberdade Assistida e a Prestação de Serviços à Comunidade como algumas das alternativas educativas designadas ao adolescente em conflito com a lei. Esta pesquisa procura romper com o que está historicamente determinado no que diz respeito a este adolescente, construindo um caminho para compreender o seu desenvolvimento no contexto em que está inserido, fazendo escuta aos discursos dos sujeitos envolvidos na aplicação e na execução da medida socioeducativa. A Psicanálise, na definição do que é uma família e quem é o sujeito em conflito com a lei, vê seguramente as questões sociais e econômicas imbricadas como causas reais, ainda que não sejam as únicas. A investigação desdobra-se a partir da visualização das mudanças que ocorrem na família e no adolescente após seu acolhimento e de sua família no Serviço das Medidas Socioeducativas. Diante de inquietações que circundam o percurso teórico, buscaremos, simultaneamente, pensar em diretrizes que orientem o caráter pedagógico da proposta endereçada aos adolescentes em cumprimento de Medidas Socioeducativas em Meio Aberto. Diante do desejo de provocar mudanças sociais, este estudo utiliza-se da pesquisa-ação como uma alternativa metodológica no campo da pesquisa social, desvelando as realidades vivenciadas no cotidiano da Pedagogia, num espaço não escolar que tenta construir caminhos possíveis para transformar a realidade, fortalecendo os sujeitos autores de ato infracional. Por tratar-se de uma caminhada em meio a histórias áridas, faz-se uma analogia com a multiplicidade de cores e formas do caleidoscópio com o adolescente que, provavelmente, é um reflexo do meio em que vive.

This thesis reports the research on the subjectivity of adolescents in conflict with the aw and the educational measures used in an open environment where they are supposed to remain when the offense happens. The "Estatuto da Criança e do Adolescente" calls for Probation and Provision Services for the Community, as well as educational alternatives assigned to adolescents in conflict with the Law. Nevertheless, the project seeks to break down what is already determined by personal history regarding the building of a new way that can be done. The socialeducational measures try to understand this youngster and his/her development in the family context listening to their speeches .Psychoanalysis has a lot to contribute to the understanding of the causes of what constitutes a family and the subject in conflict with the Law. Social and economic reasons are intertwined as real causes, but are not the only ones. The research unfolds from starting changes that occur in the family and with the adolescent after the start of the fulfillment of Socioeducational Measures . Facing that , we would simultaneously think of directives to guide the pedagogical nature of the proposal addressed to the adolescents. Wishing to make social changes, this study makes use of action research as a methodological alternative in the social research field revealing real experiences in everyday life in a non-school environment, which tries to build ways to transform reality. Considering the tough different stories heard, we made an analogy with the multitude of colors of a kaleidoscope and the teenagers, who probably are a reflection of the environment they live.
