dc.description.abstractA presente pesquisa analisa a admissibilidade do trabalho artístico infanto-juvenil na ordem jurídica brasileira, bem como a necessidade de promoção de uma melhor e mais satisfatória regulamentação a seu respeito. A Constituição Federal de 1988 encampa a proibição para “qualquer trabalho” a indivíduos com idade inferior a 16 (dezesseis) anos, prevendo uma única exceção para a modalidade de aprendizagem, quando o limite etário mínimo é fixado em 14 (quatorze) anos (art. 7°, XXXIII). Referida proibição constitucional, porém, é objeto de divergência interpretativa pela doutrina brasileira, havendo posição no sentido de considerá-la ampla e literal - abarcando todas as espécies do gênero trabalho -, e posição no sentido de restringi-la somente à relação de emprego. Desse modo, o trabalho artístico infanto-juvenil ficaria em um “limbo”, podendo ou não ser admissível. Baseando-se, pois, em um método dedutivo, e empregando técnica de pesquisa bibliográfica, buscou-se esclarecer quais seriam os possíveis sustentáculos a fundamentar essa prática tão difundida, que se tornou o labor artístico infanto-juvenil, no contexto brasileiro. Foi necessário, para tanto, examinar as possíveis colisões entre as normas constitucionais, bem como as possíveis colisões entre normas constitucionais e infraconstitucionais atinentes à matéria. Adentrou-se, por conseguinte, em um estudo acerca dos atos normativos internacionais pertinentes, verificando-se receber tal modalidade laborativa tratamento específico pela Convenção n° 138 da OIT, a qual foi internalizada pelo Estado brasileiro e assumiu status de norma supralegal e infraconstitucional, conforme posição firmada pelo Supremo Tribunal Federal. Quanto a isso foi possível observar que a Convenção da OIT, do mesmo modo, não poderia sobrepujar determinação proibitiva prevista na Constituição Federal, não encontrando o trabalho artístico, até então, guarida legal. A questão é que tal prática, desde há muito, vem sendo aceita socialmente, perfectibilizando-se como um costume social ratificado pelo Estado, merecendo fundamentação legal. Mutatis mutandis, partiu-se da hipótese de uma harmonização quando da proteção e garantia dos bens jurídicos fundamentais dos chamados artistas mirins, concluindo-se, assim, pelo desacerto na proibição total e estanque do trabalho artístico. Constatou-se, entretanto, que as previsões legais protetivas dos artistas mirins ainda são insuficientes a uma máxima e eficaz garantia de todos os direitos a eles inerentes, não se podendo abrir mão de uma regulamentação objetiva desta atividade.pt_BR
dc.description.abstractThe present research analyzes the admissibility of artistic labour of children and adolescents in the Brazilian legal system, as well as the need to promote a better and more satisfactory regulation of him. The Brazilian Federal Constitution of 1988 embodies the prohibition to “any labour” to individuals under the age of 16, and it provides a single exception to the modality of learning, when the minimum age limit is set at 14 years (art. 7, XXXIII ). This constitutional prohibition, however, is object of interpretative divergence in the Brazilian doctrine, and exist the position that it considers broad and literal – covering all species of the genus “work” – and the position that it restrict only to the “employment”. Thus, the artistic labour of children and adolescents would be in a “limbo”, because could be or not admissible. Based on a deductive method, and employing a technique of bibliographical research, it tried to clarify what are the possible grounds for this practice so diffused, which is the artistic labour of children and adolescents in the Brazilian context. It was necessary, therefore, to examine the possible collisions between constitutional rules, as well as the possible collisions between constitutional rules and not constitutional rules on the matter. Thereafter, it was made a study about the relevant international treaties, and was verified that this modality of labour receives special treatment by the Convention N° 138 of the ILO, which it was internalized by the Brazilian State and it assumed status of supra-legal and infra-constitutional norm, according to the position fixed by the Federal Supreme Court. In this regard it was observed that the ILO Convention, likewise, could not undervalue prohibitive determination provided in the Federal Constitution, and thus the artistic labour would not have a legal foundation. The problem is that this practice, has long, has been socially acceptable, and is characterized as a social custom ratified by the State and deserves legal basis. Mutatis mutandis, it started from the hypothesis of a harmonization in relation to the protection and guarantee of fundamental legal rights of the so-called junior artists. It was conclude, therefore, that the full and sealed prohibition of artistic labour is misguided. It was verified, however, that the protective legal provisions of the children artists are still insufficient for a maximum and effective guarantee of all rights attached to them, and it can’t waive a more objective regulation for this activity.en
