Organização sindical brasileira : limitações e possibilidades

Abstract

A presente investigação abordará o sistema de organização sindical brasileiro, especialmente no aspecto da liberdade sindical. De acordo com a visão de autores com posicionamentos diversos, procura-se responder em que medida a legislação vigente, em especial o que dispõe a Constituição Federal de 1988, permite a livre organização dos sindicatos e em que medida o sistema jurídico sindical limita ou concretiza as possibilidades das associações sindicais a alcançarem seus objetivos na proteção dos interesses dos trabalhadores. Além da busca por essa resposta, ainda são tecidas considerações sobre direitos fundamentais sociais, em especial os que se referem a direitos dos trabalhadores. Por fim, busca-se o necessário liame entre o importante instrumento em que se constitui o sindicato livre e a busca pela concretização da dignidade humana no trabalho.

The present investigation is going to address the Brazilian trade union system, especially in the aspect of freedom of association. In accordance with authors with different positions, we will try to answer in what extent the current legislation, in particular the disposal of the Federal Constitution of 1988, allows the free organization of trade unions and in which measure the labor legal system limits or concretized the possibilities of syndicates to achieve their goals in protecting the interests of workers. Besides the search for that answer, it is still above considerations on fundamental social rights, particularly those relating to labor rights. Lastly, it is necessary to link between the major instrument for the formation of the free trade unions and the search for the concretization of human dignity of labor.
