dc.description.abstractEste estudo examina a função social dos institutos jurídicos e as noções de justiça social e de solidariedade, necessárias para o preenchimento do conteúdo da expressão ‘funções sociais’. Pretende contribuir para uma melhor compreensão do princípio e diretriz do direito urbanístico e da política urbana das funções sociais das cidades. Analisa o significado, a natureza, os antecedentes e os pressupostos da noção jurídica de função social e a decorrente ressignificação de institutos jurídicos com esse novo elemento. Delineia a análise estrutural e a análise funcional realizada na ciência e na sociologia do direito. Estuda a questão dos direitos subjetivos e sua compatibilidade com a função social dos institutos jurídicos. Busca determinar a natureza da função social, se princípio, diretriz, cláusula geral ou conceito jurídico indeterminado. E, a partir dos caminhos percorridos para a construção e reconstrução do sentido atual das funções sociais dos institutos jurídicos, em especial da propriedade e da posse, se a função social dos institutos jurídicos constitui o substrato para o correto entendimento das funções sociais da cidade. Reflete acerca da cidade e de como se configuram suas funções sociais no âmbito do Direito, sua importância e efeitos. Quais direitos e obrigações, segundo a doutrina e a interpretação dos tribunais, emergem do cotejo do texto e no contexto concreto em que incidem para conformar as políticas públicas às funções sociais da cidade com os instrumentos constitucionais e infraconstitucionais de que dispõe o Direito brasileiro.pt_BR
dc.description.abstractThis work examines the social function of the legal institutions of Private Law and the knowledge of social justice and solidarity, necessary to fulfilling the content of the expression ‘social functions'. It intends to contribute for a better comprehension of the principle and directive of the town planning right and the urban policies of social functions of the cities. It analyzes the meaning, the nature, the records and the budgets of the legal notion of social function and the new sense of legal institutes with this element. It delineates the structural analysis and the functional analysis in the science and in Sociology of Law. It studies the question of the subjective rights compatibility with the social function of the legal institutes. It seeks to decide the nature of the social function, if principle, line of direction, general clause or indeterminate legal concept. Also from the ways covered for the construction and reconstruction of the present meaning of social functions of the legal institutes, in special the property and ownership, if the social function of the legal institutes constitutes the substratum for the correct understanding of the social functions of the cities. It reflects concerning the city and its social functions configure in the scope of the Right, its importance and effects. Which rights and duties, according the doctrine and the interpretation of the courts, emerge of the comparison of the text and in the concrete context for conforms the public politicies to the social functions of the city to the constitutional and legal instruments in the Brazilian Right.en
