dc.description.abstractO presente trabalho objetivou verificar as transformações que o direito de asilo sofre em face da criação de um espaço integrado, tal qual se apresenta a realidade da União Européia. Nessa análise, serviu a Convenção de Genebra de 1951 de eixo central, secundada por outros instrumentos internacionais referentes à proteção dos direitos humanos. Inicialmente, é feita minuciosa análise do princípio do non-refoulement e de sua fragilidade diante do direito comunitário. Destacam-se, também, os elementos extraterritoriais que, como instrumentos de política migratória, acabam por impedir o acesso de refugiados ao espaço integrado. É apreciada, igualmente, a complexa e inconsistente legislação comunitária relativa a atribuição de responsabilidades estatais frente à um pedido de asilo, tanto no seu âmbito interno, como, também, no que tange aos reenvios à Estados terceiros, a face mais oculta do direito de asilo na União Européia. Em fase posterior são analisados os fragmentados regimes de proteção comunitários que, amiúde, revelam-se insuficientes no seu alcance e, não raro, limitados pela restritiva instrumentalização procedimental. Por fim, abordam-se os direitos que são reconhecidos a aqueles que recebem proteção internacional, cuja tônica, nesse caso, é a absoluta disparidade e desarmonia entre os distintos regimes. Nas conclusões, traça-se um perfil do direito de asilo na União Européia, muito mais afeito à contenção do que ao ofertamento de refúgio no espaço integrado.pt_BR
dc.description.abstractThe present research had as its objective to verify the transformations that the right of asylum suffers in view of the creation of an integrated space, such as the European Union reality presents itself. In this analysis, the 1951 Genebra Convention worked as a main axis, being seconded by other international instruments referring to the protection of human rights. Initially, a meticulous analysis of the non-refoulement principle and its fragility before the community law is done. In addition, are distinguished the extraterritorial elements which, as instruments of migratory policy, lead to the hindering of the access of refugees to the integrated area. To an equal degree, we take into consideration the complex and inconsistent community legislation related to the attribution of state responsibilities in view of an asylum request, in its internal scope as well as in what is related to the dispatching to third party States, this one the most hidden face of the right of asylum in the European Union. In a later stage we analyze the fragmented regimes of communitarian protection which, frequently, reveal themselves to be insufficient in their reach and, not rarely, limited by the restrictive procedural instrumentalization. At last, we approach the rights which are recognized to those who receive international protection, whose emphasis, in this case, is the absolute disparity and disharmony among the different regimes. In the conclusions, we outline a profile of the right of asylum in the European Union a lot more accustomed to contention than to the offering of refuge in the integrated space.en
