dc.description.abstractO presente estudo buscou responder a seguinte questão: “é viável a regulamentação da Internet, sob a luz da Constituição brasileira?”. Tomando como base o Marco Civil da Internet (Lei nº. 12.965, de 23 de abril de 2014), ainda buscouse analisar em que medida referida lei pode viabilizar a participação política dos cidadãos junto ao Poder Público. Para tanto, num primeiro momento, investigou-se o regime jurídico da comunicação, em suas diversas modalidades, verificando-se as peculiaridades relevantes do setor, a fim de permitir um comparativo com a Internet, esta considerada em sua função de meio de comunicação. Após, num segundo momento, estudou-se as formas de governo contemporâneas (democráticas e autoritárias), a fim de se analisar a função e o tratamento concedidos à comunicação em cada um dos sistemas. Por fim, argumentos favoráveis e contrários a uma disciplina específica para a Internet foram contrapostos, com a devida análise destes sob a luz da Constituição brasileira, avaliando-se, ainda, em que medida o Marco Civil da Internet se mostra apto a efetivar a democracia participativa brasileira. Ao fim, constatou-se a viabilidade constitucional de regulamentação da Internet, juntamente com uma série de observações que podem orientar futuras intervenções no espaço virtual.pt_BR
dc.description.abstractThis study sought to answer the question: "is feasible to regulate the Internet, in the light of the Brazilian Constitution?". Building on the Brazilian Internet Civil Mark (Law nº. 12,965, of April 23, 2014) also sought to examine to what extent this law could enhance the political participation of citizens by the Government. To this end, at first, we investigated the legal framework for communication in its various forms, verifying the relevant characteristics, in order to allow a comparison with the Internet, it considered in its function of media outlet. Then, in a second time, we studied contemporary forms of government (democratic and authoritarian), in order to analyze the function and the treatment given to communication in each of the systems. Finally, arguments for and against a specific discipline for the Internet were opposed, with proper analysis of these in the light of the Brazilian Constitution, evaluating also the extent to which the Internet Civil Mark can effect the Brazilian participatory democracy. At the end, the constitutional viability of Internet regulation was recognized, along with a number of observations that can guide future interventions in the virtual space.en
