A teoria da pena na Filosofia do Direito de Hegel

Abstract

Este trabalho tem como objetivo analisar a concepção da pena na filosofia hegeliana. Para tanto, dividiu-se o estudo em duas partes, quais sejam, a crítica hegeliana à tradição do contratualismo penal e a teoria da pena na Filosofia do Direito de Hegel. Desse modo, será demonstrado em que medida Hegel suprassume as teorias filosóficas que lhe precedem ao tratar especificamente da temática da punição.

This study aims to analyze the conception of punishment in the hegelian philosophy. For that, the study is divided into two parts, namely, the hegelian critique to the tradition of criminal contractualism and the theory of punishment in Hegel’s Philosophy of Right. Thus, it will be shown how Hegel overcomes the philosophical theories that precede him, specifically in the issue of punishment.
