O Direito autoral e o equilibrio econômico frente às legislações vigentes

Abstract

Este trabalho apresenta uma perspectiva sobre o direito autoral, seu escopo de proteção através da informação como coeficiente de mensuração do seu valor econômico. O criador ou inventor de uma obra intelectual almeja através da sua criação, alcançar um retorno econômico e moral do bem. Ao passo em que se adota um regime rígido de proteção da obra enfrenta-se um dilema entre a proteção jurídica, a função social da obra e seu proveito econômico. Essa contradição se agrava com a contemporaneidade econômica, que trouxe inúmeros desafios para o Direito em todas as áreas. Existem várias funções do direito autoral, iniciando-se pelo interesse público, a identificação do autor, a de estimulo à criação, a econômica e uma função cultural e política. Quando se cria um valor econômico e social através da circulação da informação, estar-se-á, atingindo a função social da obra. Já a proteção excessiva, perderá o incentivo a criação e consequentemente a circulação da informação será prejudicada.

This paper presents a perspective about copyright and its protective scope through the information (as a coefficient measuring its economic value). The creator or inventor of an intellectual work aims, through its creation, to achieve economic and moral return with the intellectual work developed. Although we adopt a strict protection regime of the intellectual work, the copyright faces a dilemma between the legal protection, the social function of the intellectual work and economic advantage. This contradiction is exacerbated by the contemporary economy, which brought many challenges to the Law in all areas. There are several functions of the copyright, starting with the public interest, the author's identification, the stimulus for creation and the economic, cultural and political functions. When you create an economic and social value through the circulation of information, you will be reaching the social function of the intellectual work. Moreover, an excessive protection will cause loss of incentive to creation and, consequently, the circulation of information will be impaired.
