O combate à violência contra a mulher no Brasil

Abstract

O presente trabalho versa sobre a violência doméstica e familiar contra a mulher. Para tanto, inicialmente, são demonstrados alguns fatores históricos com relação a diferença de gênero que podem servir de explicação para a ocorrência dessa violência, bem como a maneira pela qual a crítica feminista foi iniciada no país. No momento seguinte, são evidenciados alguns elementos históricos sobre a violência contra a mulher, como o ciclo de agressões funciona, bem como ficam evidenciados estudos vitimológicos que possibilitam a compreensão da relação existente entre o autor e a vítima. Além disso, neste mesmo momento, é analisado o fenômeno de transmissão transgeracional, de suma importância para assimilação da reprodução de tal violência entre as gerações. No terceiro momento são demonstradas diversas informações pertinentes acerca da Lei 11.340/2006, o caminho para o surgimento e como foi sua implementação, porque ganhou o nome de Lei Maria da Penha, bem como são assinalados os tipos de violência que constam nesta referida Lei. Outrossim, são analisadas histórias verídicas onde a violência doméstica resta presente no cotidiano, sendo realizadas observações pontuais acerca de cada caso. Para a realização do referido trabalho, é utilizado o método dialético como forma de procedimento, examinando a fundo o árduo processo de combate à violência contra a mulher e a técnica de revisão bibliográfica como forma de abordagem. Ao final, conclui-se, que a complexidade do problema acontece bem antes de iniciados os relacionamentos, ainda na infância e que o surgimento de políticas públicas acerca do assunto, voltadas tanto para as vítimas, quanto para seus filhos, pode ser uma maneira eficiente para combater este tipo de violência, evitando assim sua reprodução entre gerações.

This paper deals with domestic and family violence against women. In order to do so, initially, some historical factors regarding the gender difference that can serve as an explanation for the occurrence of this violence are demonstrated, as well as the way in which the feminist critique was initiated in the country. In the next moment, some historical elements on violence against women are shown, as the cycle of aggression works, as well as the existence of victim studies that make possible the understanding of the relationship between the perpetrator and the victim. At the same time, the phenomenon of transgenerational transmission, which is extremely important for the assimilation of the reproduction of such intergenerational violence, is analyzed. In the third moment, various pertinent information about Law 11.340 / 2006, the path to the emergence and how it was implemented, was named because of the name of Maria da Penha Law, as well as the types of violence included in this Law. In addition, veridical histories are analyzed where domestic violence is present in daily life, and specific observations are made on each case. In order to carry out this work, the dialectical method is used as a procedure, examining in depth the hard process of combating violence against women and the technique of bibliographical revision as a way of approach. In the end, it is concluded that the complexity of the problem occurs well before the beginning of the relationships, even in childhood and that the emergence of public policies on the subject, aimed at both the victims and their children, can be an efficient way To combat this type of violence, thus avoiding their reproduction between generations.
