Perda do mandato por troca de partido e sistema eleitoral majoritário

Abstract

O presente trabalho tem por objetivo verificar a aplicação da hipótese da perda do mandato por troca de partido ao sistema majoritário. A Ação Direta de Inconstitucionalidade 5081/2015 alterou significativamente as regras de fidelidade partidária até então estabelecidas pela Resolução 22.610/2007, a qual disciplina o processo de perda de cargo eletivo e de justificação de desfiliação partidária. Desse modo, busca-se examinar os motivos pelos quais as regras da perda de mandato por troca de partido não mais se aplicam aos cargos do princípio majoritário.

The present study aims to verify the application of the hypothesis of the loss of the mandate by exchange of party to the majority system. The Direct Action of Unconstitutionality 5081/2015 significantly altered the rules of party loyalty until then established by Resolution 22.610 / 2007, which governs the process of loss of elective office and justification of partisan pardon. In this way, it is sought to examine the reasons why the rules of the loss of mandate by exchange of party no longer apply to the positions of the majority principle.
