A luta contra a impunidade dos crimes da ditadura chilena (1998-2013)

Abstract

As limitações impostas durante a transição da ditadura para a democracia no Chile resultaram em uma manutenção de alto grau de poder e legitimidade por parte dos militares, institucionalizada por meio da Constituição aprovada em 1980. Mesmo com o fim da ditadura e o retorno da democracia em 1990, boa parte do aparato montado nos anos de Pinochet permaneceu intacto. Apenas a partir do final da década de 90, com a reforma do judiciário em 1997, e a prisão do ditador em Londres em 1998, modificações substanciais no entendimento da Corte Suprema começaram a se desenvolver, dando início a uma nova etapa na justiça de transição chilena. O presente trabalho pretende abordar o seguinte problema: quais os fatores ocorridos na década de 90 que impactaram a luta contra a impunidade no Chile? O objetivo geral da pesquisa será analisar, através de decisões emanadas pela mais alta instância judicial chilena a partir desse ano paradigmático, os avanços e retrocessos no que concerne à responsabilização dos crimes cometidos durante a ditadura.

The limitations imposed during the transition from dictatorship to democracy in Chile resulted in the maintenance of a high degree of power and legitimacy by the military, institutionalized by the Constitution approved in 1980. Even with the end of dictatorship and the return of democracy in 1990, much of the apparatus assembled in Pinochet's years remained intact. Only in the late 1990s, with the reform of the judiciary in 1997, and the arrest of the dictator in London in 1998, substantial changes in the Supreme Court's understanding began to unfold, initiating a new stage in transitional justice in Chile. This investigation aims to address the following problem: what factors occurred in the 1990s that have impacted the fight against impunity in Chile? The overall objective of the research will be to analyze, through decisions issued by the highest judicial body in Chile since that paradigmatic year, the advances and setbacks regarding the accountability of crimes committed during the dictatorship.
