Processos participativos em defesa de direitos: a atuação da sociedade civil no Conselho Nacional de Direitos Humanos e no Comitê Nacional de Prevenção e Combate à Tortura (2013-2016)

Abstract

A pesquisa intenta apresentar um panorama dos desafios concernentes à consolidação dos processos participativos em defesa de direitos humanos no Brasil, bem como interpretar a dinâmica de duas instituições participativas de defesa de direitos: o CNDH e CNPCT. Para tanto, pretendeu-se identificar as organizações da sociedade civil que participam desses espaços, inventariar seus modelos de funcionamento, atos decisórios e analisar as atividades desempenhadas pelo CNDH e CNPCT. A pesquisa foi qualitativa examinando as atas e funcionamento da instituição. Os resultados apontam para disputas no interior dos órgãos, mantendo uma tensão política entre Estado e Sociedade Civil, sobretudo no período após o impeachment de Dilma Rousseff e a ascensão de Michel Temer, período em que os colegiados incorporaram um papel mais intenso de oposição, ainda que discursiva, contra as agendas governamentais. No tocante à finalidade institucional das instituições participativas, observam-se impactos ainda limitados. Um resultado da atuação do CNPCT e do CNDH parece ser instrumentalizar um movimento de contra hegemonia à retirada de direitos.

The research intends to presents a panorama of the challenges concerning the consolidation of participative processes in defense of human rights in Brazil, to interpret the dynamics of two participative institutions of rights defense: the Human Rights National Council and the Committee for the Prevention against Torture. The research pretended to identify the civil society organizations that participates of those spaces, to inventory their models of functioning, its decision acts and to analyze the activities of HRNC and CPAT. It was a qualitative research examining memories of reunions and the functioning of the institutions. The results point out for the disputes inside the organs maintaining a political tension amongst State and Civil Society, mainly in the period following the impeachment of Dilma Rousseff and the ascension of Michel Temer, when the institutions incorporated a more intense role of opposition, even discursive against governmental agendas. Regarding the institutional ends of the participatory institutions it was observed limited impacts. One of the observed results of the role of the HRNC and CPAT apparently was to perform a movement of counter hegemony against withdraw of rights.
