O advogado e o dever de veracidade

Abstract

O presente trabalho objetiva investigar a conduta advocatícia à luz do dever de veracidade de modo a compreender como deve o advogado atuar em juízo a fim de que não infrinja o dever jurídico em estudo. Busca-se, mediante análise doutrinária e jurisprudencial, compreender o conteúdo e limitações legais do dever de veracidade, bem como de que forma ele se harmoniza com os demais deveres éticos da advocacia. A fim de cumprir esse desiderato, o presente trabalho é estruturado em três capítulos. No primeiro capítulo, são estudados os fundamentos do dever de veracidade na legislação processual civil, no Código de Ética e Disciplina e Estatuto da Advocacia, buscando-se compreender as bases teóricas do dever em estudo, sua relevância na construção de narrativas pelo advogado e porque esse dever é necessário no contexto do processo justo. No segundo capítulo, são estudados o conteúdo e limites do dever de veracidade, buscando compreender quais os elementos que compõem uma narrativa processual e de que modo se pode verificar sua falsidade e como deve agir o advogado ao construir narrativas processuais a fim de não violar o dever de veracidade. Por fim, no último capítulo, são estudadas as consequências da violação ao dever de veracidade, buscando-se compreender de que modo a violação ao dever em estudo é identificada no caso concreto e quais são as sanções processuais e disciplinares cabíveis a quem violou o dever em comento. Ao final, conclui-se que, apesar de o advogado ter o dever de construir uma narrativa processual que seja persuasiva e favorável a seu cliente, não poderá ele usar de mentiras ou omissões em sua construção.

The present study aims to investigate the lawyer's conduct in light of the duty of veracity in order to understand how the lawyer must act in court so that he does not violate the legal duty under study. Through doctrinal and jurisprudential analysis, it is sought to understand the content and legal limitations of the duty of veracity, as well as how it harmonizes with the other ethical duties of advocacy. In order to fulfill this objective, the present work is structured in three chapters. In the first chapter, the foundations of the duty of veracity in the Civil Procedure Code, the Ethics and Discipline Code and the Advocacy's Statute are studied, in order to comprehend the theoretical basis of the studied duty, its relevance in the construction of narratives by the lawyer and why this duty is necessary in the context of the fair trial. In the second chapter, the contend and limits of the duty of veracity are studied, with the aim of understanding the elements that make up a procedural narrative, how can its falsity be verified and how should a lawyer act when constructing procedural narratives that do not violate the duty of truthfulness. Finally, in the last chapter, the consequences of the violation of the duty of veracity are studied, in order to understand how the violation of the duty under study is identified in the specific case and what are the procedural and disciplinary sanctions applicable to those who have violated the duty in comment. In the end, it is concluded that, although the lawyer has a duty to construct a procedural narrative that be persuasive and favorable to his client, he cannot use lies or omissions in its construction.
