O trabalhador hipersuficiente no âmbito da "reforma" trabalhista : "Aqueles que concordam, permaneçam como estão"

Abstract

Este trabalho analisa a tramitação da “Reforma” Trabalhista, que altera diversos artigos da CLT e cria a categoria denominada de trabalhador hipersuficiente, buscando descrever e interpretar o processo legislativo que culmina na Lei nº 13.467/17. Com o propósito de compreender a origem e as razões que implicam na formulação da nova categoria, pesquisou-se a tramitação legislativa do Projeto de Lei nº 6.787/16, a partir da sua apresentação na Câmara dos Deputados até a aprovação e envio para o Senado Federal. Com base na coleta de dados efetuada, argumenta-se que a categoria de trabalhadores hipersuficientes surge em um espaço de discussão superficial, sem que os efeitos da sua criação sejam debatidos de forma minimamente razoável, sendo que a sua aprovação ocorre na esteira das demais alterações efetuadas na CLT. Após analisar os seus principais aspectos, são discutidas as semelhanças com o trabalhador pejotizado, sendo cogitada a possibilidade de inserção deste trabalhador através da roupagem de hipersuficiente.

This paper analyzes the process of the Labor “Reform”, which changes several articles of the CLT and creates the category called hypersufficient worker, seeking to describe and interpret the legislative process that culminates in Law nº 13.467/17. With the purpose of understanding the origin and the reasons that imply in the formulation of the new category, the legislative process of the Bill nº 6.787/16 was researched, from its presentation in the Chamber of Deputies until its approval and submission to the Federal Senate. Based on the data collection carried out, it is argued that the category of hypersufficient workers comes up in a space of superficial discussion, without the effects of its creation being debated in a minimally reasonable way, and its approval occurs in the wake of other changes made in the CLT. After analyzing its main aspects, the similarities with the “pejotizado” worker are discussed, considering the possibility of insertion of this worker through the guise of hypersufficient.
