Coerção e distribuição : liberdade e direitos individuais em Nozick

Abstract

A legitimidade do Estado e o espaço permitido para o exercício do poder sem coerção são temas dos mais importantes dentro da filosofia política. Sua relevância para a compreensão das estruturas estatais que nos cercam e até mesmo para o entendimento da liberdade humana são inegáveis. A partir da obra de Robert Nozick, Anarquia, Estado e Utopia, foi realizado um estudo sobre a possibilidade da existência do Estado sem coerção, da estrutura dos direitos individuais e dos problemas presentes na legitimação do poder como exercido hoje. Examinou-se ainda a proposta de Rawls em sua obra A Theory of Justice, apontando-se criticamente as falhas contidas nos princípios da equidade e da diferença, bases de sua teoria do contrato social, bem como as falácias contidas na idéia do véu de ignorância. Por fim, o trabalho empreendido foi uma reflexão sobre a própria natureza das relações de poder, resultando, ao menos por enquanto, na conclusão de que apenas o anarco-capitalismo seria capaz de tomar o espaço estatal sem admitir a coerção em sua própria definição.

The legitimacy of the state and the space allowed for the exercise of power without coercion are some of the most important themes in political philosophy. Its relevance for understanding the state structures that surround us and even to the understanding of human freedom is undeniable. From the work of Robert Nozick, Anarchy, State and Utopia, a study was made on the possibility of the existence of the state without coercion, the structure of individual rights and the problems present in the legitimacy of power as exercised today. It also examines the proposal of Rawls in his book A Theory of Justice, pointing out critically flaws contained in the principles of equality and difference, bases of his social contract theory, as well as the fallacies contained in the idea of the veil of ignorance. Finally, the undertaken work was a reflection on the nature of power relations, resulting, at least for now, the conclusion that only anarcho-capitalism would be able to take the State’s place without admitting coercion in its own definition.
