dc.description.abstractO presente trabalho trata da medida de quebra de sigilo telefônico em juízo penal, que é uma restrição aos direitos fundamentais à intimidade e à privacidade do indivíduo por parte do Estado, regulada na Lei 9.296/96. A pesquisa pretende analisar os pressupostos legais e constitucionais para a implementação da medida, além de examinar julgado (case) relativo à matéria, realizando um levantamento de como a questão é tratada pela magistratura brasileira. Apesar de a legislação e a Constituição determinarem que o deferimento de interceptação telefônica deve ser excepcional e estar condicionado a diversos requisitos, limitando a ação do Estado de modo a proteger as garantias individuais do cidadão, observamos que a medida acaba sendo largamente deferida, sem a adequada observação dos pressupostos. A legislação específica demonstra algumas impropriedades, mas o maior responsável pela inadequada leitura do instituto da interceptação telefônica (além de outros que também envolvam direitos fundamentais) é o discurso punitivista e inquisitorial presente na sociedade e que acaba permeando o ideário dos julgadores. Para verificar a ocorrência de tal situação, o presente trabalho optou por, além de realizar um levantamento jurisprudencial e doutrinário acerca do tema, selecionar e analisar um case consistente em uma decisão judicial do Superior Tribunal de Justiça, utilizando como critérios os posicionamentos nela encontrados e a abrangência com que a matéria das interceptações foi tratada. A análise do case, em comparação aos posicionamentos jurisprudenciais e, principalmente, doutrinários, permitiu perceber que o modelo processual penal inquisitorial se encontra largamente difundido nos ideais judiciais, em prejuízo do garantismo penal e do sistema acusatório colocados pela Constituição, restando feridos direitos e garantias fundamentais do indivíduo pela indiscriminada e inadequada autorização de medidas restritivas de direitos, em especial as interceptações telefônicas. Ficou evidenciada a necessidade de o Judiciário assimilar um pensamento adequado aos ideais constitucionais de garantias fundamentais, de modo a não permitir que esses sejam violados por abusos por parte da máquina estatal.pt_BR
dc.description.abstractThe present work deals with the judicial disclosure of telephone records in criminal law, which is a restriction to the fundamental rights of intimacy and privacy of the individual by the State, regulated by the Law 9.296/96. The research aims to analyze the legal and constitutional requirements for the implementation of the measure, in addition to examine a judicial case related to the subject, proceeding to an issue of how the question is treated by the Brazilian magistrates. Although the legislation and the Constitution determine that the disclosures must be exceptional and subject to several requirements, limiting the action of the State in a way that protects individual rights of citizens, we observe that the measure turns to be largely authorized, without the proper respect for the requirements. The specific legislation demonstrates some inadequacies, but the greatest responsible for the inadequate reading of the institute (in addition to other institutes that involve fundamental rights) is the punitive and inquisitorial discourse that exists in this society and that permeates the ideals of the judges. To verify the occurrence of such a situation, this paper chose to, besides conducting a survey of jurisprudence and doctrine related to the subject, select and analyze a case consisting of a judicial decision of the Superior Court (STJ), using as criteria the positions found in it and the range obtained by the discussion of the disclosure subject. The analysis of the case, in comparison to the jurisprudential and, mainly, doctrinal positions, allowed us to realize that the inquisitorial model of penal procedure (process) finds itself widely spread in the judicial ideals, to the detriment of the criminal garantism and the accusatory system elected by the Constitution, injuring fundamental rights by the uncontrolled and inadequate authorization of rights restricting measures, particularly the disclosure of telephone records. We saw demonstrated the necessity of the Judiciary to assimilate an understanding coherent to the constitutional ideals of fundamental rights, in a way that does not allow the violation of these rights by the State.en
