O direito fundamental à moeda saudável na Constituição da República Federativa do Brasil de 1988

Abstract

Esta monografia tem como objetivo, auxiliada pelo instrumental da ciência econômica, extrair do ordenamento jurídico brasileiro o direito fundamental à moeda saudável. Em primeiro lugar, são trabalhados os aspectos econômicos e os aspectos jurídicos da moeda. Analisam-se, após a etapa inicial, a Constituição Econômica e a relação da moeda saudável com os fundamentos, os fins e os princípios daquela. Na sequência, é realizado o estudo dos direitos fundamentais atinentes ao objeto desta monografia, chegando-se à configuração do direito fundamental à moeda saudável; examinam-se, por fim, o instituto jurídico da ação popular e a sua aplicabilidade na materialização e na defesa do direito fundamental à moeda saudável. Ao longo desta obra, são investigados temas correlacionados, os quais, embora secundários e auxiliares, revelam-se, por via reflexa, sobremaneira importantes para o assunto deste trabalho.

This monograph, aided by the instrumental of economics, aims at extracting from the Brazilian legal order the fundamental right to healthy currency. First, the economic and the legal aspects of the money are worked. After the initial stage, the Economic Constitution and the healthy currency relationship with its fundamentals, purposes and principles are analyzed. Further, the study of the fundamental rights pertaining to the subject of this monograph is conducted, coming to the configuration of the fundamental right to healthy currency; finally, we examine the legal institution of popular action and its applicability in the materialization and in the defense of the fundamental right to healthy currency. Throughout this work, related issues are investigated, which, although secondary and auxiliary, reveal themselves, by reflex, exceedingly important to the subject of this paper.
