Mulher : "inferiorização" e violência doméstica : história da posição social feminina e a análise da violência doméstica contra a mulher na atualidade

Abstract

O presente trabalho busca compreender a situação da mulher na sociedade atual, especialmente no que concerne o fenômeno da violência doméstica contra ela. Para tanto, em primeiro lugar, analisou-se a História, desde a Era Primitiva até a fase contemporânea, focando na posição ocupada pela mulher na sociedade, que pode ser considerada "inferior" na maior parte do tempo. Em seguida, passou-se a analisar, de forma mais específica, a violência doméstica contra a mulher na sociedade brasileira. Para tanto, fez-se uma retrospectiva histórica da brasileira, desde as "índias", africanas e primeiras europeias, até os dias atuais. Depois dessa mirada, o foco passou a ser a violência doméstica na sociedade brasileira através da apresentação de dados estatísticos e da análise do seu tratamento, que se deu, de forma concreta, a partir da implantação da primeira delegacia da mulher em 1985, seu posterior "choque" com os Juizados Especiais Criminais, até a criação da Lei Maria da Penha e sua recente discussão no Supremo Tribunal Federal.

This paper seeks to understand the situation of woman in the current society, especially regarding the phenomenon of domestic violence against her. Therefore, first, it analyzed the history, since to the primitive age to the contemporary phase, focusing on the position occupied by woman in society, which can be considered "inferior" most of the time. Then it started to analyze, more specifically, domestic violence against woman in Brazilian society. For both, it was a historical retrospective of Brazilian, from the "Indies", African and first European women until nowadays. After this glance, the focus is shifted by the domestic violence in Brazilian society through the presentation of statistical data and analysis of their treatment, which occurred in a concrete way, from the deployment of the first woman police station in 1985, it‘s later "clash" with the Special Criminal Courts, until the creation of Maria da Penha Law and its recent discussion on the Supreme Court.
