A problemática contemporânea dos refugiados : instrumentos normativos internacionais e regionais de proteção

Abstract

O presente trabalho dedica-se, primordialmente, ao estudo das principais formas de proteção aos refugiados, tanto no sistema global quanto no sistema regional, enfocando os instrumentos jurídicos utilizados para este fim, como a Convenção do Estatuto dos Refugiados de 1951, o seu Protocolo Adicional de 1967, a Declaração de Cartagena e a Lei 9.474/97. Para concretizar este estudo, ele foi dividido em duas partes: na primeira, enfoca-se o aspecto histórico da evolução do refúgio, bem como dos seus instrumentos normativos, além de abordar a questão dentro da América Latina. Na segunda, apresenta a realidade brasileira sobre a matéria e aponta as ações e inovações trazidas pela legislação do país bem como as ações realizadas, contando com o apoio do governo, do ACNUR e da sociedade civil organizada.

This work is dedicated, primarily, to the study of the major forms of refugee protection, both in the global as the regional system, focusing on the legal instruments used for this purpose, such as the 1951 Refugees Status Convention, its 1967 Addition Protocol, the Cartagena Declaration and the Law 9.474/97. To achieve this study, it was divided in twp parts: the first, focus on the aspect of the historical evolution of the refuge, as well as its normative instruments, in addition to addressing the issue within Latin America. The second, presents the Brazilian reality on the matter, pointing actions and innovations brought by the laws of the country as well as the actions taken, with the support of the government, UNHCR and organized civil society.
