dc.description.abstractA Constituição brasileira de 1988 veda a retroatividade das leis em geral e da lei tributária em especial. Isto está previsto expressamente nos artigos 5º, XXXI, no caso das leis em geral, e no artigo 150, III, “a”, no caso da lei tributária. Ao teor deste dispositivo “é vedado a União, aos Estados e aos Municípios cobrar tributos em relação a fatos geradores ocorridos antes do início da vigência da lei que os houver instituído ou aumentado”. Na sua interpretação, a jurisprudência do Supremo Tribunal Federal considera que o momento da ocorrência do fato gerador é determinado pelo aspecto temporal da hipótese de incidência da norma tributária. Para o STF este é o único critério a ser utilizado e por meio dele o Supremo Tribunal determina se a lei é ou não retroativa. O problema é que a utilização de um único critério não soluciona adequadamente todos os casos que dizem respeito a uma lei retroativa. Isso decorre, por um lado, do fato de que a retroatividade não atinge o indivíduo apenas na sua relação com a obrigação tributária; uma lei retroativa alcança outros âmbitos da vida, em especial, a liberdade e a propriedade do indivíduo. Por outro lado, no contexto do artigo 150, III, “a”, a expressão fato gerador ocorrido adquire diversos significados. Segundo a tese deste trabalho, o aspecto temporal da hipótese de incidência é um, porém não é o único critério que deve ser utilizado para a determinação do momento em que se considera ocorrido o fato gerador. Em outras palavras, o critério de determinação do momento em que se dá por ocorrido o fato gerador deve ser obtido mediante um procedimento de ponderação que leve em conta as circunstâncias fáticas e os bens e direitos constitucionalmente protegidos presentes no caso. Isso resulta da natureza normativa dos artigos 150, III, “a” e 5º, XXXI. Eles são dispositivos que veiculam normas de direitos fundamentais, portanto apresentam uma dupla natureza normativa: são regras e, ao mesmo tempo, são princípios. Daí que, em um Estado de Direito, eles devem ser interpretados sob a perspectiva do princípio da segurança jurídica. Isto vale especialmente para o caso do artigo 150, III, “a”, no que se refere à identificação do critério que deve determinar a ocorrência do fato gerador. Para tanto, ainda sob o prisma do princípio da segurança jurídica, um papel especial é desempenhado pelo princípio mais específico da proteção da confiança. Ele auxilia no procedimento de ponderação, interpretando os fatos e a eficácia do critério utilizado, e autoriza a escolha do critério mais eficiente.pt_BR
dc.description.abstractThe Brazilian Constitution of 1988 prohibts the retroactivity of laws in general and in particular the tax law. It is very clear in articles 5th, XXXI in case of laws in general, and in article 150,III, “a”, in the case of the tax law. The content of this article “ it is forbidden to the Union, the States and the Counties to charge taxes regarding events occurred before the validity of the law that may have established or increased them”. In its interpretation, the jurisprudence of the Federal Supreme Court considers that the moment of the occurence of the generator fact is determined by the temporal aspect of the hypothesis of the incidence of the tax law. For the FSC this is the only criterion to be used and through it the Supreme Court determines whether the law is retroactive or not. The problem is that the use of only one criterion does not adequately solve all the cases that are related to a retroactive law. On one side, it happens due to fact that the retroactivity does not affect the individual only in its relation to the tax obligation, a retroactive law reaches other areas of life , in particular , the liberty and the property of the individual. On the other hand, in the context of article 150, III, “a”, the expression generator fact occurred acquires several meanings. According to the thesis of this work, the temporal aspect of the hypothesis of incidence is one, but not the only criterion that must be used for the determination of the moment in which you consider that the generator fact happened. In other words, the criterion for the determination of the moment in which the generator fact occurred must be obtained through a procedure of evaluation that takes into account the factual circumstances and the properties and rights constitutionally protected envolved in the case. It results from the normative nature of articles 150 , III, “a” and 5th, XXXI. They are articles that carry regulations of fundamental rights, therefore have a double normative nature: they are rules and, at the same time, they are principles. Thus in a State of Law, they must be interpreted under the perspective of the principle of legal certainty. It especially applies to the case of article 150, III, “a”, regarding the identification of the criterion that must determine the occurence of the generator fact. Still, under the view of juridical security, a special role is played by the most specific principle of protection of confidence. It helps in the procedure of ponderation, interpreting the facts and the efficacy of the criterion to be used, and it leads to the choice of the most efficient criterion.en
