Bêbados, vadios e turbulentos : termos de bem viver e controle social no Segundo Reinado

Abstract

A História do Direito constitui terreno ainda pouco aprofundado nos estudos jurídicos, sendo geralmente considerada ciência meramente auxiliar. No entanto, uma compreensão plena do fenômeno do Direito passa necessariamente pelo reconhecimento da sua indissociável dimensão histórica. Levando isso em conta, o presente trabalho procurou investigar essa faceta do Direito por meio da análise qualitativa de seis processos de termos de bem viver produzidos pelo Judiciário gáucho entre 1856 e 1876 e arquivados no Arquivo Histórico do Rio Grande do Sul (AHRS) e Arquivo Público do Estado do Rio Grande do Sul (APERS). Por meio da utilização desses documentos, o Estado brasileiro do século XIX, com a ação de policiais, juízes e outros agentes públicos a serviço do Império, impunha penas aos indivíduos cujas condutas eram consideradas lesivas ao sossego público. Em um primeiro momento, estudaram-se aspectos metodológicos da História e da História do Direito, apresentando-se um breve panorama das principais escolas de pensamento dessas áreas, com destaque para a Escola dos Annales e para os estudos históricos embasados em documentos judiciais. No segundo capítulo, foram analisados os aspectos jurídicos dos termos de bem viver, tais como atores processuais, condutas enquadradas e demais questões doutrinárias. Ainda, foi apresentado o embasamento legal para a aplicação desse instrumento legal de controle social, especialmente no que pertine aos sentidos político-ideológicos das diversas reformas da legislação penal imperial. Finalmente, o último capítulo buscou reconhecer o processo político e social ao qual a prática jurídica expressa pelos termos de bem viver estava alinhada. Assim, identificou-se na utilização desse mecanismo de Direito Penal a manifestação de um projeto político excludente com vista ao controle social e à “domesticação” de indivíduos que se afastassem dos valores liberais incorporados pelas elites que participaram do processo de construção do Estado-nação brasileiro.

Legal History still hasn‟t been enough studied in the Law field, being generally considered an auxiliary science. However, a full comprehension of the Law phenomenon must necessarily recognize its historical dimension. Taking that in account, this work aimed to investigate this aspect of Law through the qualitative analysis of six termos de bem viver legal proceedings which were produced by the gaúcho judicial system between 1856 and 1876 and filed at the Arquivo Histórico do Rio Grande do Sul (AHRS) and Arquivo Público do Rio Grande do Sul (APERS). Through the usage of these documents, the Brazilian State of the 19th century, with the action of policemen, judges and other public agents in service of the Empire, imposed penalties to individuals who were considered detrimental to law and order. First of all, methodological aspects of History and Legal History were studied, and the main schools of thought of these areas were presented, especially the Annales School and the historical studies concerning judicial documents. In the second chapter, legal aspects of the termos de bem viver were analysed, such as its actors, framed conducts and other legal aspects. The legal grounds for the utilization of this legal instrument of social control were also presented, especially concerning the political and ideological meanings of the legal reforms of the penal legislation during the Empire. Finally, the last chapter aimed to identify the political and social process which the termos de bem viver were aligned to. Therefore, it was identified in the utilization of this Criminal Law mechanism the expression of an exclusionary political project with the intention of social control and “domestication” of individuals who weren‟t aligned to the liberal values incorporated by the elites that participated in the construction of the Brazilian national state.
