Em vez de prisionizar, socializar : a incompatibilidade entre o encarceramento e a inserção social

Abstract

O presente estudo pretende demonstrar os efeitos causados pelo encarceramento no indivíduo que infringe a lei penal, tanto de ordem psicológica como de ordem social, evidenciando a dificuldade de reinserção social do egresso do sistema penitenciário. No primeiro capítulo, procura-se explicar de que maneira se dá o processo de institucionalização do preso, e de que forma este fenômeno age sobre sua identidade. No segundo capítulo, o foco volta-se para a relação do preso com a sociedade. Nesse momento, objetiva-se analisar a estigmatização do condenado perante o corpo social, bem como a influência que a rotulação exerce sobre a atuação das instituições de direito penal. Explica-se de que forma a seletividade dos órgãos oficiais de controle possui papel fundamental na reincidência do condenado. No terceiro capítulo, procura-se, por meio do exame das funções da pena, demonstrar que a pena privativa de liberdade, nos moldes atuais, caminha de encontro ao objetivo de reinserção social do preso. Finalizando o trabalho, pretende-se, por meio da referência às Associações de Proteção e Assistência aos Condenados (APAC), propor uma reflexão acerca da importância do envolvimento e da colaboração da sociedade na reintegração do ex-presidiário ao convívio social.

This study intends to show the effects caused by imprisonment to the one that infringes the law, whether from psychological or social order, highlighting the reinsertion difficulty when egressing from the penitentiary system. In the first chapter, the inmate’s institutionalization process is explained, and how this phenomenon influences its identity. In the second chapter, the focus turns to the relationship between inmate and society. In this moment, the goal is to analyse the convict’s stigmatization before the social body, as well as the influence that the labelling exerts on the performance of the criminal law institutions. Explains how the selectivity of the official control departments has a key role on the convict relapse. In the third chapter, it demonstrates through the penalty functions exam that the private freedom penalty, in the current form, walks towards the social reinsertion of the inmate. In the final phase it is intended to propose, through the Association of Protection and Assistance to Convicts (APAC), a reflection around the importance of the involvement and the society’s collaboration on the reintegration of a former inmate to social living.
