Caracterização de união estável

Abstract

O presente trabalho tem como objetivo analisar a construção histórico-cultural da sociedade brasileira que elevou a união estável ao patamar que ocupa atualmente, perpassando pelos diversos períodos temporais desta evolução. Serão analisados os princípios constitucionais aplicados ao Direito de Família e a sua influência para o pensamento a cerca do citado instituto. Este trabalho procura principalmente debruçar-se sobre os elementos utilizados para que se identifique a união estável, estabelecendo as divergências existentes sobre os pontos polêmicos, sem deixar de falar nos direitos e deveres advindos da união estável e da sua dissolução.

This study aims to analyze the historical and cultural construction of Brazilian society that elevated the stable union to the level currently held, traversing the various time periods in its evolution. Constitutional principles applied to family law and their influence on the thought of the institute mentioned will be analyzed. This study addresses the elements used to identify a stable union, establishing the differences on controversial points, while talking about the rights and duties arising from law marriage and its dissolution.
