dc.description.abstractO presente trabalho trata da alteração superveniente das circunstâncias e o seu impacto sobre a relação contratual, em especial, no âmbito do contrato de empreitada. Na primeira parte, traça-se perfil histórico do tema, marcando-se a oscilação entre a rigidez do princípio pacta sunt servanda, cerne da própria ideia de contrato como elemento estabilizador de relações econômicas, e o extremo oposto, qual seja a possibilidade de alteração ou extinção do pacto em face da alteração das circunstâncias que deram ensejo à contratação (cláusula rebus sic stantibus). Na primeira seção, apresenta-se o tema da cláusula rebus sic stantibus com as três principais teorias que dela exsurgiram. Na segunda seção, demonstra-se a recepção da teoria da excessiva onerosidade superveniente no âmbito do Código Civil de 2002. Na segunda parte, passa-se a examinar o tema sob a perspectiva do contrato de empreitada. Em um primeiro momento, define-se o âmbito normativo do tipo contratual da empreitada (contrato de obra), ainda objeto de controvérsia na doutrina brasileira. Em um segundo momento, analisam-se as regras específicas do Código Civil para este tipo contratual. Em especial, enfoca-se aquelas que tratam da relação entre empreitada e eventuais alterações supervenientes das circunstâncias. Por fim, demonstra-se a possibilidade de aplicação das regras gerais do Código Civil que consagram a teoria da excessiva onerosidade superveniente (tanto aquelas de revisão como as de resolução) aos contratos de empreitada.pt_BR
dc.description.abstractThe present essay deals with the subsequent change of circumstances and its impact on the contractual relationship, in particular, under the construction contract. In the first part, we draw historical profile of the issue by checking the oscillation between the rigidity of the principle pacta sunt servanda, core of the very idea of contract as a stabilizing element of economic relations, and the opposite extreme, namely the possibility of alteration or termination of the agreement in the face of changing circumstances that underlie the formation of the contract (rebus sic stantibus clause) . In the first section, we present the theme of rebus sic stantibus with three main theories that outcome from it. In the second section, the reception of the theory of supervening excessive burden under the Civil Code of 2002 is presented. The second part examines the issue from the perspective of the construction contract. At first, it sets the legal framework of the contractual nature of the construction contract, still the subject of controversy in the brazilian doctrine. In a second step, the specific rules of the Civil Code for this type of contract are analyzed. In particular, the rules dealing with the relationship between construction and any subsequent changes in circumstances are focused. Finally, it demonstrates the possibility of application of the general rules of the Civil Code which establish the theory of supervening excessive burden (both those of the review as resolution) for construction contracts.en
