Dos condomínios fechados : a (i)legalidade frente à função social da propriedade

Abstract

A presente dissertação é uma análise crítica do fenômeno de criação de condomínios fechados em áreas urbanas. Discute-se as possíveis respostas jurídicas que são oferecidas à sua solução pelo Direito Brasileiro, apresentando pontos favoráveis à regularização deste instituto, o qual já existe de fato, quanto indicando conflitos que podem decorrer de seu reconhecimento legal. A reflexão é realizada a partir do referencial teórico e do confronto entre as construções teóricas acerca do papel do condomínio fechado no contexto social e da sua regulamentação sob a óptica do Direito Civil e do Direito Urbanístico. Conclui-se pela incompatibilidade da atual situação do condomínio fechado com a regulamentação usada para legitimá-lo, o que aponta para urgência de adoção de medidas, pela Administração Pública, para o cumprimento da função social. Busca-se responder à questão: quais são as condições presentes em condomínios horizontais fechados, em relação ao cumprimento da função social da propriedade urbana? Partindo-se desse questionamento, a metodologia: i) identifica as leis e as formas como elas permitem o surgimento e o desenvolvimento dos condomínios horizontais fechados (em Porto Alegre); ii) relaciona os resultados alcançados na proposição de subsídios ao processo de gestão urbana na alteração da legislação na direção do cumprimento legal constitucional. As conclusões apontam sob que condições os empreendimentos fechados realizam a função social da propriedade e, a partir daí, busca-se uma regra geral e generalizável sobre condomínios fechados, debatendo e elucidando sobre a importância de os mesmos receberem uma legislação específica, formulada com o objetivo de cumprir com a função social da propriedade.

This dissertation is a critical analysis of the phenomenon of creation of “gated communities” in urban areas. It discusses the possible legal responses that are offered to it’s solution by the Brazilian law and points out the conflicts that may arise from their legal recognition. A reflection is done from the theoretical framework and is developed a confrontation between the theoretical constructs about the role of social context in the gated community and its regulation from the perspective of the Civil Law and the Urban Law. We conclude that the current situation of incompatibility of the “gated community” with the rules used to legitimize it, points to the urgent adoption of measures by the public authorities, for the fulfillment of the property social function. It seeks to answer the question: what are the conditions present in “gated communities” in relation to the fulfillment of the social function of urban property? Starting from this question, the methodology: i) identifies the laws and the ways that they allow the emergence and development of “gated communities” (Porto Alegre); ii) lists the results achieved in proposing subsidies to the process of urban management in changing the direction of constitutional law in legal compliance. The findings indicate under what conditions the “gated communities” realize the social function of property and, from there, we seek a general and generalizable rule about them, debating and clarifying the importance of receiving the same specific legislation, formulated in order to fulfill the social function of property.
