Os impactos da reforma trabalhista brasileira no princípio constitucional do acesso à justiça

Abstract

A presente pesquisa tem como objetivo analisar os impactos da Lei n° 13.467/2017 no Princípio Constitucional do Acesso à Justiça, identificando os seus dispositivos que possam inviabilizar ou dificultar o acesso dos trabalhadores à Justiça do Trabalho. Para isso, serão feitas considerações acerca do direito fundamental do acesso à justiça e da evolução histórica das relações de trabalho, bem como serão analisados os dispositivos que trazem novos regramentos acerca da gratuidade da justiça, dos honorários de sucumbência e dos honorários periciais. Analisar-se-ão, ainda, os dispositivos que inseriram na esfera jus laboral o termo de quitação anual e a possibilidade da instituição da cláusula de compromisso arbitral de forma individual.

This research aims to analyze the impacts of the Law N ° 13.467/2017 in the Constitutional Principle of Access to Justice, identifying its devices that can make it impossible or to hinder workers' access to Labor Justice. To this end, consideration will be given to the fundamental right of access to justice and to the historical evolution of labor relations, as well as to the analysis of the provisions that bring new regulations regarding the gratuitousness of justice, fees of succumbing and expert fees. It will also be analyzed the devices that inserted in the jus labor field the annual disbursement term and the possibility of the institution of the clause of arbitration commitment individually.
