Sanctuary cities : um estudo comparado entre as leis de imigração e refúgio brasileiras e americanas em contexto federativo

Abstract

O presente trabalho realiza um estudo de direito comparado entre os ordenamentos jurídicos americano e brasileiro no que diz respeito ao tratamento jurídico dispensado a imigrantes e refugiados no contexto de Estados Democráticos de Direito pautados pelo federalismo. Utilizando-se dos métodos indutivo, factual e contextualizado, parte-se da análise de casos concretos, sendo nos Estados Unidos da América a controvérsia entre localidades e governo federal referente às sanctuary cities e, no Brasil, a crise gerada pelo influxo massivo de imigrantes e refugiados venezuelanos em Roraima, especialmente nas cidades de Pacaraima e Boa Vista, pretendendo-se (i) entender o funcionamento das sanctuary cities nos EUA e a controvérsia jurídico-constitucional entre estas localidades e o governo federal, bem como os principais pontos das leis sobre imigração e refúgio locais e (ii) compreender a crise gerada no Estado de Roraima com a chegada em massa de imigrantes e refugiados venezuelanos e a controvérsia jurídico-constitucional entre a referida Unidade Federativa e o Governo Federal, a ser utilizada como recorte para a análise dos principais pontos das leis referentes à imigração e ao refúgio no Brasil. A conclusão a que se chega é que se faz necessário estabelecer mecanismos jurídicos de integração dos imigrantes e refugiados nas localidades em que aportem, tendo sempre em vista a observância dos direitos humanos neste processo, uma vez que tal integração tende a beneficiar as sociedades como um todo. Na última seção, são também sugeridas possibilidades de novas abordagens sobre o tema.

This work realizes a comparative law study between the american and brasilian law aspects refering to the legal treatment of immigrants and refugees in the context of democratic states of law based on the federalist system. Using the inductive, factual and contextualized methods, and departing from the analysis of concrete cases, concerning, in the United States of America, the controversy between localities and the federal government about the sanctuary cities and, in Brazil, the crisis generated because of the massive influx of venezuelan immigrants and refugees in Roraima, especially in the cities of Pacaraima and Boa Vista, this work seeks to (i) understand the functioning of the sanctuary cities in the USA and the juridic and constitutional disagreement between these localities and the federal government, as well as acknowledge the main points of the immigration and refuge law in USA, and (ii) comprehend the crisis caused in the State of Roraima with the massive influx of venezuelan immigrants and refugees and the juridic and constitutional controversy between this State and the Federal Government, in this work used as an approach to analyse the main points of the laws refering to immigration and refuge in Brazil. As a conclusion, it is infered that to estabilish legal mechanisms of integration of the immigrants and refugees in the localities where they arrive is a necessity, having always in mind the observance of the human rights in this process, given that this integration tends to benefit societies as a whole. In the last section, possibilities of new approches on the subject are suggested.
