A viabilidade dos processos estruturais no ordenamento jurídico brasileiro

Abstract

O processo estrutural é uma espécie de procedimento de caráter coletivo proveniente dos Estados Unidos. A partir do leading case Brown v. Board of Education, os juízes norte-americanos utilizaram-se de medidas estruturantes para dar efetividade aos valores inscritos na Constituição. Sabe-se que o direito brasileiro também convive com problemas relacionados à concretização dos direitos fundamentais, tendo em vista que as lides individuais quanto as coletivas não tratam as causas dessas questões, e sim as suas consequências. Nesse sentido, o método de abordagem propiciado pelo processo estrutural apresenta-se com uma alternativa a ser explorada pelo Poder Judiciário para solucionar litígios complexos. Considerando o país de origem do instituto, já se tinha conhecimento que a Common Law é um ambiente propício para o desenvolvimento dos processos estruturais. De outro lado, a adstrição à lei habitualmente associada à Civil Law poderia impossibilitar a postura ativa e criativa dos magistrados que a reforma estrutural exige. Por isso, este trabalho questiona a viabilidade das medidas estruturantes no Brasil. Para tanto, conceitua-se os processos estruturais, apresentado suas características e peculiaridades. Assim, através da análise dos dispositivos disponíveis no ordenamento jurídico brasileiro, esta monografia busca os princípios e técnicas processuais que já se conciliam com os processos estruturais e quais ainda precisam ser adaptados.

The structural injunction is a sort of collective procedure from the United States. Since the leading case Brown v. Board of Education, US judges use injunctions to enforce the values contained in the Constitution. It is known that Brazilian law also lives with problems related to the realization of fundamental rights, given that individuals lawsuits as much as the collective ones do not treat the causes of these issues, but rather their consequences. Thus, the method of approach proposed by the structural injunction is presented as an alternative to be explored by the Judiciary to solve complex disputes. Considering the institute's country of origin, it was already know that the Common Law is a conducive environment for the development of structural injunctions. On the other hand, a restriction of law usually associated with Civil Law could make unfeasible the active and creative posture of magistrates that the structural reform requires. Hence, this paper questions the viability of structured injunctions in Brazil. To do so, the concept of structural injunction will be defined, presenting it characteristics and peculiarities. Therefore, through the analysis of devices available in the Brazilian legal system, this monograph seeks the principles and procedural techniques that are already reconciled with the structural injunctions and which still need to be adapted.
