Desde a publicação das Leis nº 10.833/2003 e 10.637/2002, tal conceito era determinado pelas Instruções Normativas SRF nº 247/2002 e 404/2004, as quais adotaram como parâmetro o contato direto adotado pelo IPI. Os contribuintes questionaram esse entendimento e judicializaram a questão, chegando ao julgamento do STJ, REsp nº 1.221.170/PR. Assim, o objetivo geral desse estudo é identificar os critérios adotados pelo Recurso Especial para o conceito de insumo para fins de apuração do crédito do PIS e da COFINS não cumulativos. Esta pesquisa é considerada de caráter qualitativo, descritiva e documental, envolvendo um estudo jurisprudencial e doutrinário nas várias correntes que tratam do tema. Fez-se uma relação com a responsabilidade do profissional contábil em entender todo esse contexto, orientar e assessorar seus clientes, e os reflexos negativos que podem ocorrer se esse acompanhamento não for bem feito. Analisando a definição de insumos trazida pelo STJ, com base nos critérios da essencialidade ou da relevância, vê-se que esse novo paradigma não solucionou o problema dos litígios, pois criou mais uma discussão sobre esses novos critérios. ...

Cofins and PIS are two of the main taxes as a federal government revenue source. One of the main disputes involving these contributions is the definition of the concept of input. Since the publication of Laws 10.833/2003 and 10.637/2002, this concept was determined by Normative Instructions SRF 247/2002 and 404/2004, which adopted the direct contact adopted by the IPI as a parameter. Thus, the general objective of this study is to identify the criteria adopted by the Special Appeal for the concept of input for purposes of calculating non-cumulative PIS and COFINS credit. This research is considered to be qualitative, descriptive and documentary, involving a jurisprudential and doctrinal study in the various currents that deal with the theme. A relationship was made with the accounting professional's responsibility to understand this whole context, guide and advise his clients, and the negative effects that can occur if this monitoring is not done well.
